Cards Terms and Conditions
These Terms and Conditions apply to Your Card, and together with the Master Terms (to the extent applicable to Your Card), constitute the legal relationship between You and Us.
These Terms and Conditions govern Your application for, holding and use of Your Card, and You must read these Terms and Conditions carefully.
By authorizing a Member to apply for, hold or use a Card, You will be deemed to have accepted these Terms and Conditions. If You do not accept these Terms and Conditions, You must not authorize any Member to apply for, hold, or use a Card. You remain fully liable for any act, omission, decision, or other conduct of any Member relating to the application for, possession of, or use of the Card. This includes any breach of these Terms and Conditions committed by a Member.
Your Card is issued in Hong Kong by, and Your Card is the property of Sunrate Solutions Limited, Room 11114, 11/F, YF Life Tower, 33 Lockhart Road, Wanchai, Hong Kong S.A.R. (" Sunrate"). Sunrate is a Money Service Operator regulated by the Customs and Excise Department in Hong Kong under registration number 2437623. Your Card is not transferable.

1. Definitions
" App" means the Statrys mobile application which is available for download from Apple's App Store and the Google Play Store.
" Business Day" means any day (other than a Saturday or Sunday) on which banks are open in Hong Kong for normal banking business.
" Card" means the Statrys Mastercard® card issued by Sunrate to the Member(s) whether in the form of a plastic, digital or virtual card, under these Terms and Conditions.
" Card Information" means any and all of the following pieces of information: Your Card details (Card number, expiry date and CVV code), Your PIN, and any information You use to log in to the Website or the App.

" Fees Table" means the table of fees and charges applicable to the Card as set out on the Website (Pricing page).
" Mastercard®" means Mastercard International of New York or its successors or assigns.
" Member" means any shareholder, director or employee affiliated to You that You have expressly authorized to apply for, hold or use a Card.
" Merchant" means a retailer or any other person or firm or company providing goods and/or services that accepts cards displaying the Mastercard® acceptance symbol in payment for such goods and/or services.
" Network" means a major national or international network or association such as American Express, Mastercard, Visa, RuPay, JCB, Discover, UnionPay or any other global or local network or association that We may work with from time to time to enable the use of the Card.
" PIN" means the personal identification number which We may issue or approve to be used with Your Card.
“ Pre-funding Account” means an account in the name of Sunrate that is used for settlement of Transactions made on the Card.
" Account" means the business account You maintain with Statrys Limited for the purpose of using the money changing service or remittance service provided by Us. By accepting these Terms and Conditions, You acknowledge and agree that We are not a bank or an issuer of a stored value facility, and that the Account is not a bank account or a stored value facility. By accepting these Terms and Conditions, You undertake that You will not use the Account as a bank account or a stored value facility, otherwise We may terminate your use of the Account. Any funds held in Your Account is not protected by the Deposit Protection Scheme in Hong Kong.
" Terms and Conditions" means these terms and conditions together with the Fees Table and any supplementary terms and conditions and amendments to them that We may notify You of from time to time.
" Transaction" means any ATM withdrawal in certain countries, any purchase of goods and/or services online or at a point-of-sale completed by using Your Card, or any action which alters the balance of Your Account, including a redemption instruction.
"Us" or "We" or "Our" means Statrys Limited.
" Website" means www.statrys.com.
"You" or "Your" means the corporate entity entering into these Terms and Conditions with Us by authorizing a Member to apply for, hold, or use a Card. Where the context requires, references to "You" or "Your" may also be construed as referring to the relevant Member authorized by You to apply for, hold, or use the Card.
2. Fees
2.1. The use of Your Card is subject to the fees set out in the Fees Table (available on our Pricing page). These fees are part of these Terms and Conditions. More specifically, We may, at Our discretion, charge and deduct the following fees from Your Account:
(i) fee for the issuance, maintenance, replacement and/or renewal of the Card, whether in virtual or physical form, including any applicable fees for replacement Cards (including applicable fees incurred by Sunrate);
(ii) administrative and transaction fees for foreign currency transactions and transactions processed outside Hong Kong;
(iii) administrative fee for the production or retrieval of any documents relating to the Card; and
(iv) any other fees for any services provided or action taken by Us or Sunrate in connection with any Transactions with or through selected Merchants and/or payment intermediaries, or for costs incurred to rectify errors, pursue wrongful chargeback claims, or for investigation of disputed transactions.
2.2. Any or all of the above fees may be waived or reduced at Our discretion. Our fees may change over time; if so We will notify You in advance of such changes in accordance with Section 3.1.
2.3. Third parties, like ATM providers and Merchants, may charge fees for the use of the Card in addition to the fees set out in the Fees Table. This may include merchant surcharges that will be applied upon confirmation of the transaction amount, and which You will not be able to dispute once confirmed.
2.4. Fees will be paid from Your Account at such time as they are incurred at such time or as specified in a monthly statement. You must ensure Your Account balance is sufficient to cover the cost of any Transaction and any associated fees. We have the right to use the Available Balance to settle outstanding balances and fees.
2.5. Without prejudice to the foregoing, We may charge:
(i) any sum howsoever due and owed to Us by You as a result of using the Card; and/or
(ii) any fees, costs and/or expenses incurred by Us to rectify any error in payment or record, whether arising from the reversal of any Transaction or otherwise in relation to the use of the Card.
3. These Terms and Conditions
3.1. We may change these Terms and Conditions including changing existing fees, introducing new fees, or adding or removing functionality, from time to time. Where required, we will provide You with no less than 30-days’ notice before the proposed change comes into effect. However, changes that relate to exchange rates shall come into effect immediately if so stated in the change notice. All such changes will be posted on the Website with a link to the amended terms and conditions and shall be notified to You either by (i) sending an email to the email address registered with Your Account, or (ii) requesting that You accept the amended terms and conditions when You access the Website.
3.2. The up-to-date version of these Terms and Conditions will be posted on the following URL statrys.com/cards-terms-and-conditions. You should check the Website regularly so that You can see the latest version. You will be bound by these Terms and Conditions and any amendments made to them. We recommend that You print off a copy of these Terms and Conditions to keep for Your records. By applying for, or using, a Card, You confirm that You accept and agree to these Terms and Conditions as it may be amended from time to time by Us.
3.3. Your continued use of the Card after any changes of the Terms and Conditions shall constitute Your consent and acceptance of these Terms and Conditions. In this respect, You will be taken to have accepted any change We notify to You unless You expressly tell us in writing that You do not agree to it prior to the relevant change taking effect. If you do not agree, please do not apply for, or use, your Card. In such circumstances, We will treat Your notice to Us as a notification that You wish to terminate these Terms and Conditions immediately.
4. Card issuance
4.1. You may apply for a Card via the Website or the App. All Cards are issued by Sunrate pursuant to a license granted by Mastercard® to Sunrate. Cards may be issued by Sunrate in the form of a virtual Card or a physical Card. All Cards remain Sunrate’s property, and We may request that Members return all Cards to Sunrate at any time.
4.2. To apply for a Card You must be at least 18 years old. Before Sunrate can issue You a Card, We will need to know some information about You. We will check Your identity and where You live. We may use third parties to obtain this information and carry out checks on Our behalf, this may include using credit reference agencies. However, a credit check is not performed and Your credit rating will not be affected. You must provide, or procure the provision of, Member information, and inform Us promptly if any Member information changes.
4.3. If You make an application for a physical card, We will send the Card (issued by Sunrate) to the relevant address notified by You.
4.4. We reserve the right to refuse to issue a Card to You, or to limit the number of Cards issued to You, at Our sole discretion.
4.5. If You have any problems with Your Card please contact Customer Services.
4.6. If You receive a plastic Card, You must sign it as soon as You receive it and activate it. Activation instructions are set out on the packaging that Your Card is attached to. Your Card cannot be used until this is done. A virtual Card can be used immediately upon receipt and does not need to be activated.
4.7. You agree that a Member shall comply with these Terms and Conditions as well as any additional guidelines or policies provided by Us.
4.8. You are primarily liable for all actions and transactions made by the Member using the Card, and are responsible for all actions taken by the Members in connection with the Cards. We reserve the right to refuse issuance of a Card to any Member or to cancel a Card at any time for any other reason as permitted under these Terms and Conditions.
4.9 You represent and warrant that all Members requested by You shall have appropriate authorisation to use Cards and agrees that We do not have any obligation to verify such authorization.
5. Use of Your Card and the App
5.1. When You make a Transaction using Your Card, the settlement of the Transaction will be made by Sunrate from its Pre-funding Account. The balance in Your Account will subsequently be reduced by Us by the value of the Transaction plus any fees incurred for such Transaction.
5.2. The Card is not for personal use and it shall be used by You exclusively in relation to Your business operations and for legitimate and lawful business purposes.
5.3. A Virtual Card consists of a 16-digit account number, expiry date, and “CVV/CVV2” code and can be used for purchases via phone, internet, or any other “card not present” electronic transaction where Mastercard® cards are accepted. Virtual Cards cannot be used to make a payment in person or in any transaction which requires the use of a Physical Card. A Virtual Card can be used immediately upon receipt and does not need to be activated.
5.4. A Physical Card must be signed by the Member holding the Card as soon as received and activated, using the instructions on its packaging, before it can be used. Physical Cards may be used for both “card present” and “card not present” electronic transactions where Mastercard® cards are accepted. We may permit the use of physical Cards for cash withdrawals at an automated teller machine (ATM).
5.5. The Member’s signature, PIN, or other authentication on the Member’s part may be required for each Transaction. The Member only, and no one else, may use the Card to effect Transactions on the Card, subject to these Terms and Conditions.
5.6. You are liable for all purchase of goods and/or services at a point-of-sale (“ PoS Transactions”) incurred on the Card regardless of whether the PoS Transactions were properly authorized by You. You acknowledge the ease of which unauthorized PoS Transactions may be carried out and accept the risk of unauthorized PoS Transactions.
5.7. You must keep Your PIN and other Card Information safe and not share them with any other person, and You must ensure that You log out of the App after using it.
5.8. We may, at Our own discretion, set transaction limits for the usage of the Card on a per-day or per-transaction basis, and reserve the right to limit the number of Cards You may request or have active at any given time.
5.9. Be aware that some ATM providers charge additional fees for the use of their ATMs and some Merchants add a surcharge for using certain types of cards. You may also be subject to their terms and conditions of business. It is Your responsibility to check before proceeding with Your Transaction.
5.10. Card Transactions may require Our authorization. We reserve the right to decline any Transaction and/or suspend the use of a Card at Our discretion without giving any advance notice, including but not limited to in circumstances where:
(i) the balance in Your Account is insufficient;
(ii) the Transaction exceeds any transaction limit on the Card from time to time;
(iii) We suspect that there is fraud or a security issue with the Card;
(iv) We suspect that the Card is being used in a way that contravenes these Terms and Conditions or for an illegal purpose;
(v) We suspect that a Member has materially breached the Agreement or these Terms;
(vi) limitations exist due to product design or features;
(vii) internal risk control measures and policies dictate;
(viii) the Transaction falls under categories or Merchants that are not allowed as per the policies applicable to the Card;
(ix) compliance with anti-money laundering and counter-financing of terrorism (AML/CFT) laws, regulations, sanctions, or other regulatory controls is required;
(x) issues or restrictions are imposed by third parties involved in the transaction processing, including the Network, acquiring banks, or payment processors; or
(xi) technical issues or system maintenance affect Our ability to process transactions
Such declines may be initiated not only by Us but also by Sunrate and other parties involved in the card issuing or transaction processing, such as the Network, acquiring banks, payment processors, or regulatory bodies. We shall not be held liable for any losses, damages, or inconvenience resulting from these declines, regardless of the initiating party.
5.11. If We refuse to authorize a Transaction, We will, if practicable, tell You why immediately unless it would be unlawful for Us to do so. We will give You notice of any suspension and the associated reasons as soon as possible after implementing the suspension, unless it would compromise Our reasonable security measures or otherwise be unlawful. You may correct any information We hold and which may have caused Us to refuse a Transaction by contacting Customer Service.
5.12. For authorization purposes, We may require the Member to confirm their identity by following certain steps specified by us in the App. You acknowledge and agree that We are not liable to You or any other person for any loss suffered as a result of an authorization not being granted.
5.13. Certain merchants may require pre-authorization of the estimated amount, or a certain percentage, of the final amount of a Transaction. The pre-authorization amount will be held in the Pre-funding Account. The balance in Your Account may also subsequently be reduced by any such pre-authorization amount. Any portion of such pre-authorized amount which is not applied to the final Transaction will be subsequently returned to the balance in Your Account. This means that some of the balance on Your Account may be held for a period until Sunrate and the Merchant has settled the Transaction amount and, accordingly, You will not be able to use such amount during this period. We cannot release such amount without authorization from the Merchant and Sunrate.
5.14. We shall not be liable if a Merchant refuses to accept Your Card or if We do not authorize a Transaction, or if We cancel or suspend use of Your Card. Unless otherwise required by law, We shall not be liable for any loss or damage You may suffer as a result of Your inability to use Your Card for a Transaction.
5.15. You agree that once We notify You of any amount owed to Statrys that is outstanding, You must immediately pay such outstanding amount to Statrys. In such case, You authorize and agree that We may in our discretion deduct any outstanding amount from Your Account. We may in our discretion suspend Your Card and any other Cards connected to You if you have any outstanding amount owed to Us. You are not entitled to withhold payment from Us because of any unresolved complaint, claim or dispute with a merchant.
5.16. Merchants may not be able to authorize a Transaction if they cannot obtain online authorization from Us. Any refunds for goods or services purchased with Your Card will first be returned to the Pre-funding Account and will subsequently be returned as a credit to Your Account. You are not entitled to receive refunds in cash.
5.17. We accept no responsibility for the goods or services purchased by You with Your Card. All such disputes must be addressed directly with the Merchant providing the relevant goods or services. Once You have authorized Your Card to make a purchase, We cannot stop that Transaction. However, where You have used Your Card to buy goods or services You may have a claim against the Merchant if the goods or services are unsatisfactory, not supplied, supplied only in part or do not match the supplier’s description.
5.18. A Card Transaction will be regarded as authorized by You, either at the point of sale by following the instructions provided by the Merchant, or for a redemption instruction by following the instructions provided by Customer Services, which includes:
(i) entering Your PIN or providing any other security code;
(ii) signing a sales voucher;
(iii) providing the Card details and/ or providing any other details as requested;
(iv) waving or swiping the Card over a card reader;
(v) inserting a Card and entering Your PIN to request a cash withdrawal at an ATM;
(vi) making a request for a cash advance at any bank counter; and
(vii) entering a one-time passcode in the App which we will send to the mobile number that You have registered with Us.
Authorisation for a Transaction may not be withdrawn (or revoked) by You after the time We have received it. However, any Transaction which is agreed to take place on a date later than the date it was authorised may be withdrawn if You give notice to the Merchant (providing a copy of the notice to Us) as long as notice was provided no later than the close of business on the Business Day before the Transaction was due to take place. We may charge You a fee if a Transaction is revoked by You under this Section (see the Fees Table for details).
5.19. You can use the App to manage Your Card, view recent Card Transactions, view Card spend limits, change or request reset of Your PIN.
6. Transactions made in foreign currencies
6.1 Your Card is denominated in Hong Kong Dollars (“ Card Currency”). If You use Your Card to purchase goods or services or withdraw cash in a currency other than the Card Currency, then such Transaction will be converted to the Card Currency on the day We receive details of it. The conversion shall be based on Our prevailing foreign exchange rates, which shall be determined by Us in Our sole discretion.
6.2 While the Transaction is settled by Sunrate from the Pre-funding Account, You must also ensure that you have sufficient balance in the Card Currency in Your Account (the “ Available Balance”) to cover any Transactions made on the Card, including associated fees. If you initiate a Transaction without sufficient Available Balance, we may use funds held in Your Account in another currency. Any such conversion will be made at our prevailing foreign exchange rates, determined at Our sole discretion.
6.3 You acknowledge and agree that Statrys has no control over the foreign exchange rates selected by Mastercard, and Mastercard may charge a fee as part of this conversion process.
7. Refund, Chargeback and Incorrect Transactions
7.1. If You wish to receive a refund after conducting a Transaction (" Refund"), You should approach the Merchant directly with the request. If the Merchant in its discretion decides to process the request for a Refund, We will credit Your Account with the Refund after Sunrate receives the relevant amount from the Merchant. We shall not be obliged to investigate or defend the validity and/or value of any Refund.
7.2. If You wish to receive a refund from a Merchant in respect of a disputed Transaction (“ Chargeback"), You should promptly approach Statrys with the request and supporting documents relating to the operation. Under the prevailing scheme rules for the Card, the overall time limit to file a claim for a Chargeback is within 120 days. If the dispute is resolved in Your favour, We will credit Your Account with the Chargeback after Sunrate receives the Chargeback. If You wrongly make a chargeback claim, We will be entitled to charge You any fees We reasonably incur in pursuing the chargeback claim and We will be entitled to debit Your Account with the amount of any such fees
7.3. You acknowledge and agree that the amount of any Refund or Chargeback received pursuant to any Transaction may be different from the amount originally processed on the Card due to exchange rate fluctuations, transaction fees, or the amount received with respect to any Refund or Chargeback being a partial refund of the original amount. You acknowledge and agree that We will not be responsible for any such shortfall.
7.4. If We refund a Chargeback to Your Account and subsequently receive information to confirm that the Transaction was authorized by You and correctly posted to Your Account, We shall deduct the amount of the Chargeback from the balance in Your Account. If there is no or insufficient balance then the provisions regarding You having an outstanding amount owed to Statrys on Your Account will apply.
7.5. If Our investigations discover that the disputed Transaction was genuine and authorized by You directly or indirectly, or that You have acted fraudulently or with gross negligence, We may charge You an investigation fee (see the Fees Table for details).
7.6. Subject to Clause 11, You shall be entitled to a refund in the amount of a Transaction incorrectly executed by Us (“ Incorrect Transaction”) and, where applicable, restoration of Your Account to the state it would have been in had the Incorrect Transaction not taken place, provided You have notified Us of the Incorrect Transaction in question without undue delay and in any case no later than 13 months after the debit date (save where We have failed to provide or make available the required Transaction information to You). Any undue delay in making a notification may result in You being liable for any losses as a result. We will make the refund immediately unless We have any reason to believe that the incident may have been caused by Your breach of these Terms and Conditions, Your negligence or if We have reasonable grounds to suspect that it has been caused by Your fraudulent behaviour, deception or other wrongdoing perpetrated by You.
8. Card expiry and damaged Cards
8.1. Your Card is valid for the period stated on the Card, unless its use is terminated earlier by Us in accordance with these Terms and Conditions. You will not be able to use Your Card once it has expired. We may request Sunrate to renew Your Card when it expires and a Fee may apply (see the Fees Table for details). We reserve the right to request Sunrate to decline to issue a replacement Card.
8.2. If You ask, We may request Sunrate to replace a damaged Card. If We do this a fee may apply (see the Fees Table for details). You will be asked to provide Us with Your Card number and other information so that We can identify You.
9. Keeping Your Card and Your Card Information safe
9.1. You shall:
(i) reserve the use of the Card to Members exclusively;
(ii) give the PIN to the relevant Member exclusively;
(iii) not record the PIN in any manner on any digital or physical material likely to be lost or stolen simultaneously with the Card;
(iv) not use identifiable numbers for the PIN which could be easily guessed by someone else than the Member; and
(v) regularly monitor Your Account to make sure no unauthorized Transactions have occurred.
9.2. You must keep Your Card and Your Card Information safe. Your Card and Your Card Information are personal to You and You must not give them to anyone else to use. You must take all reasonable precautions to prevent fraudulent use of Your Card and Your Card Information.
9.3. You will receive a PIN for Your Card and You must keep Your PIN safe. This means that when You receive Your PIN You must memorise it. You must keep Your PIN secret at all times. You must not disclose Your PIN to anyone including friends, family or Merchant staff.
9.4. If You suspect that someone else knows Your PIN or any other Card Information, You must contact Customer Services immediately. If You forget Your PIN You can access it when You log on to Your Account.
9.5. You shall comply with any additional security requirements notify by Us from time to time.
9.6 We may request additional information from You in connection with any alleged or suspected unauthorized use, fraud, or misuse of the Card, including the date(s) of transaction(s), amount(s), details of the Merchant, and any other details that may assist Us in investigating. You agree that You will cooperate with Us in investigating any alleged or suspected unauthorized use, fraud, or misuse of a Card.
9.7. We may disclose any information We believe to be reasonable to law enforcement agencies if We suspect there has been any unauthorized use, misuse or fraud in connection with Your Card.
10. Lost or stolen Cards or Card Information
10.1. If the Card is lost or stolen or if You believe that the Card or the Card Information may be misused, You shall:
(i) without undue delay, notify and give Us written notice thereof;
(ii) assist in the recovery thereof or stop the use of the Card immediately; and
(iii) make a formal police report upon the occurrence of such event, and furnish Us with the police report and a written confirmation of such loss, theft or unauthorized disclosure and any other information We may require.
10.2. After You provide Us with the written notification based on clause 10.1 above, We shall cancel the Card and prevent the issuance of any additional Card to You until the matters have been resolved.
10.3. If Your Card is reported lost or stolen We may request Sunrate to issue a new one. A fee may apply (see the Fees Table for details). If You find Your Card after You have reported it lost, stolen or misused, You must destroy it and inform Us immediately by contacting Customer Services.
10.4 If You find Your Card after You have reported it lost, stolen or misused, You must destroy it and inform Us immediately by contacting Customer Services.
10.5 You will be liable for any losses incurred in respect of an unauthorized Transaction where You have delayed the reporting of the loss, theft, or misuse of the PIN, or Card Information. This liability will apply to all losses until such time as You notify Us of the loss, theft, or misuse of the Card
11. Liability
11.1. You agree and acknowledge that You are responsible and liable for any and all Transactions made by any Members.
11.2. You shall be liable for all losses incurred in respect of an unauthorized Transaction where:
(i) You have acted fraudulently;
(ii) You have breached or compromised the security of Your Card and/or Your Card Information;
(iii) You have provided any of Your Card Information to another person who then uses those details to make a Transaction; or
(iv) You have delayed the reporting of the loss, theft or misuse of the Card or the Card Information;
In these circumstances, We reserve the right to charge You for any reasonable costs that We incur in taking action to stop Your Card being used and to recover any monies owed as a result.
11.3. If Our investigations show that a Transaction reported by You as unauthorized was in fact authorised by You, or You have acted with intent or negligence, We may reverse any refund made and You may be liable for any loss We suffer from Your use of Your Card.
11.4. Our liability to You under these Terms and Conditions shall be subject to the following exclusions and limitations and We will not be liable for any loss arising from:
(i) a Merchant refusing to accept Your Card; or
(ii) Us suspending, restricting or cancelling Your Card or refusing to issue or replace Your Card if We suspect Your Card is being used in an unauthorised or fraudulent manner, or as a result of You breaking an important term or repeatedly breaking any term in these Terms and Conditions;
(iii) Our compliance with any applicable laws, regulations or Mastercard rules; or
(iv) loss or corruption of data unless caused by Our wilful default/wrongdoing.
11.5. Unless otherwise required by law or as set out in these Terms and Conditions, We will not be liable to You in respect of any losses You or any third party may suffer in connection with the Card as a result of Our actions which were not a foreseeable consequence of Our actions.
11.6. We will not be liable for the goods or services that You purchase with Your Card.
11.7. From time to time, Your ability to use Your Card may be interrupted, e.g. when We carry out maintenance. If this happens, You may be unable to:
(i) use Your Card to pay for purchases or obtain cash from ATMs (if applicable); and/or
(ii) obtain information about Your recent Transactions; and/or
(iii) make Transactions using Your Card.
11.8. Where the Card is faulty, Our liability shall be limited to the replacement of the Card.
11.9. Where sums are incorrectly deducted from Your Account, Our liability shall be limited to repayment to You of the amount of the Incorrect Transaction in accordance with Clause 7.6 herein.
11.10. Nothing in these Terms and Conditions will exclude or limit Our liability for death or personal injury or to the extent that it cannot otherwise be limited or restricted by law.
12. Statements
12.1. You can view Your Transactions via the Website and the App at any time. You should regularly review your transactions. If You believe someone else is using Your log on details or may know them, You must contact Customer Services immediately.
12.2 You are responsible for confirming the correctness of the transaction statements for Your Card, which is part of the transaction statements of Your Account. If You dispute any transaction amount, fee or charge (collectively “Charge”), You must notify Us no later than five days from the statement date, otherwise We will treat the statement as conclusive evidence of its contents. We will take reasonable steps to assist You to resolve disputed Charges by providing information about the disputed Charge.
13. Cancellation, termination and suspension
13.1 You may apply to cancel the Card through the Website or the App, or by giving Us written notice. The Card shall only be cancelled upon confirmation by Us.
13.2 Upon the cancellation of the Card, any accrued liabilities and all obligations under these Terms and Conditions will remain, and We shall remain entitled to debit from Your Account any amount outstanding and owing to Us, including any charges and payments owing from Transactions carried out before cancellation of the Card.
13.3. When Your Card is cancelled You must destroy it by cutting it in half through the chip and magnetic strip.
13.4. We may cancel, suspend or terminate Your Card at any time without giving any reason or notice to You.
13.5. Without limiting the generality of the foregoing, We may cancel, suspend or terminate Your Card immediately if:
(i) You are in breach of these Terms and Conditions;
(ii) You violate or We have reason to believe that You are in violation of any law or regulation that is applicable to Your use of Your Card;
(iii) We have reason to believe that You are in any way involved in any fraudulent activity, money laundering, terrorism financing or other criminal activity;
(iv) We can no longer process Your Transactions for any legal or security reason or due to the actions of any third party;
(v) You refuse to co-operate in an investigation or to provide adequate identity or security information or documentary evidence for verification when requested;
(vi) We have reason to believe that Your Card or conduct poses a security, credit, fraud, business or reputational risk to Us;
(vii) We need to do so in order to comply with applicable law or regulation or Mastercard rules;
(viii) We are required to do so by any applicable regulatory body;
(ix) You fail to pay any fees or charges that You have incurred or You have an outstanding amount owed to Statrys;
(x) We discover that any information You have provided is incorrect or incomplete;
(xi) if a Transaction has been declined for any reason; or
(xii) Your Card has not been used for any Transactions for more than 3 months.
13.6. These Terms and Conditions will terminate in the event of Your death, deregistration, winding-up or dissolution, as applicable.
13.7. If any Transaction, fee or charge is found to have been incurred using Your Card following cancellation or termination, You agree to pay all such sums to Us immediately on demand.
13.8. The rights conferred on Us under these Terms and Conditions shall survive termination.
14. Expiration
14.1. The Card shall expire on the date printed on the respective card or specified on the Website and/or the App, or as otherwise notified to You.
14.2 Upon expiration date, the Card will be deactivated and You will not be able to use the Card. You will remain liable for Transactions made until the Card expires.
14.3 Sunrate may automatically issue a new Card before the expiry date of an existing Card. If You wish to continue using the Card after its expiry, You shall apply for a new Card.
15. Personal data
15.1. The processing of Your personal data is governed by Our privacy policy which can be found at https://statrys.com/terms-and-conditions/privacy-policy/. By accepting these Terms and Conditions, You also agree to the terms of Our privacy policy.
16. Your details
16.1. You must let Us know as soon as possible if You change Your name, address, telephone number or email address. If We contact You in relation to Your Card, for example, to notify You that We will be changing the Terms and Conditions or have cancelled Your Card, We will use the most recent contact details You have provided to Us. Any email to You will be treated as being received as soon as it is sent by Us.
16.2. We will not be liable to You if Your contact details have changed and You have not told Us.
17. Complaints procedure
17.1. We take all complaints seriously. Any complaints about Our services should be addressed to the chat function on the Website or by contacting our customer support team at support@statrys.com. You should expressly indicate that You are wishing to make a complaint to Us. This helps us to distinguish a complaint from an ordinary query.
17.2. Our goal is to provide You with a prompt answer and resolution to Your complaint where possible. However, nothing contained within these Terms and Conditions constitutes a commitment by Us to resolve your complaint.
17.3. A final response to Your complaint, or an email explaining why the final response has not been completed, will be sent as soon as reasonably practicable after We complete the review of the complaint.
18. Customer Services
18.1. The Customer Service department is open from 9am to 6pm Hong Kong Time, Monday to Friday (except for public holidays in Hong Kong) via phone (+852 5803 2818) and email ( support@statrys.com). We may save any email correspondence You have with Customer Services for training and/or monitoring purposes. Customer Services will be provided by Statrys Services (Thailand) Ltd. acting on Our behalf.
19. General
19.1. In these Terms and Conditions, headings are for convenience only and shall not affect the interpretation of these Terms and Conditions. Any delay or failure by Us to exercise any right or remedy under these Terms and Conditions shall not be interpreted as a waiver of that right or remedy or stop Us from exercising Our rights at any subsequent time.
19.2. You may not transfer, novate, assign, subcontract or delegate Your rights or obligations under these Terms and Conditions. You agree that We may transfer or assign Our rights or novate Our obligations under these Terms and Conditions at any time without prior written notice to You and without Your further consent. If You do not want to transfer to the new card issuer You may contact Us and We will terminate Your Card.
19.3. We may subcontract any of Our obligations under these Terms and Conditions.
19.4. These Terms and Conditions are subject to amendment, modification or deletion if required by, or found to be in conflict with, applicable law or regulation, without affecting the validity or enforceability of the remaining terms and conditions. In the event that any part of these Terms and Conditions are held not to be enforceable, this shall not affect the remainder of these Terms and Conditions which shall remain in full force and effect.
19.5. You will remain responsible for complying with these Terms and Conditions until Your Card is closed (for whatever reason) and all sums due under these Terms and Conditions have been paid in full.
19.6. These Terms and Conditions are written and available only in English and all correspondence with You in respect of Your Card shall be in English. In the event that these Terms and Conditions are translated, the version in English shall take priority.
19.7. These Terms and Conditions are governed by the laws of Hong Kong S.A.R and You agree to the non-exclusive jurisdiction of the Hong Kong courts.
